25th U.S.-China Joint Commission on Commerce and Trade Concludes with Key Outcomes

U.S. Secretary of Commerce Penny Pritzker and U.S. Trade Representative Michael Froman hosted a Chinese delegation led by Vice Premier Wang Yang for the 25th session of the U.S.-China Joint Commission on Commerce and Trade (JCCT), which took place in Chicago. At the conclusion of the discussions, the United States announced key outcomes in the areas of agricultural market access, intellectual property rights protection, innovation policies, and competition law enforcement.

Through sustained engagement over the course of this past year, the United States and China have reached agreement in several areas of key importance to U.S. farmers, innovators, manufacturers and workers, including in the following areas:

  • Agriculture market access:  China has made commitments that should promote significant increases in U.S. exports of soybeans, corn and dairy products to China.  Specifically, China announced that it would approve the importation of new biotechnology varieties of U.S. soybeans and corn ­– current annual U.S. exports of soybeans and corn to China total $14 billion and $3.5 billion, respectively – and also that it would pursue a regular dialogue with the United States focused on the benefits of the increased use of innovative technologies in agriculture, for both the United States and China. China also agreed to strong IP protections for products that use trademarks or common names like "parmesan" or "feta" cheese, which in recent years have begun to demonstrate a potential for rapid export growth vis-à-vis China.
  • IPR protection:  China's IPR-related commitments cover a range of needed improvements, which should benefit U.S. businesses in a wide variety of industries that rely on the ability to protect their trade secrets, as well as U.S. holders of patents, trademarks and copyrights. For example, in the area of trade secrets, building on prior bilateral commitments made by China, the United States has gained China’s agreement to take specific additional steps to protect companies’ trade secrets and to work on a new trade secrets law to further enhance their protections.  The United States also has secured China’s agreement to, among other things, bring new focus to the two countries’ work together to determine how best to foster a better environment for facilitating increased sales of legitimate intellectual property-intensive goods and services in China.
  • Innovation policies:  The United States continued to pursue changes to Chinese policies and practices that have pressured foreign companies to transfer valuable intellectual property rights to enterprises in China.  For example, China committed to ensure that they treat foreign IP rights the same as domestic IP rights.  China also has agreed to streamline China’s regulatory processes and cut red tape for imports of new, innovative pharmaceuticals and medical devices, which should lead to increases in U.S. exports and U.S. jobs in these two important sectors.  Indeed, according to industry data, the U.S. pharmaceuticals industry directly employs more than 810,000 workers and supports a total of 3.4 million jobs in the United States, while annual exports of U.S. pharmaceutical products to China have exceeded $1.2 billion.  The U.S. medical device industry, meanwhile, includes over 7,000 companies, most with less than 100 employees, supports 1.9 million U.S. jobs overall, and was responsible for $2.7 billion in exports to China in 2013. 
  • Competition policy enforcement:  The United States was able to address a significant concern for many foreign companies, which have expressed serious concern about insufficient predictability, fairness and transparency in the investigative processes of China’s Anti-Monopoly Law enforcement.  The Chinese side agreed that, under normal circumstances, a foreign company in an Anti-Monopoly Law investigation would be permitted to have counsel present and to consult with them during proceedings.  China also made several additional commitments, including to treat domestic and foreign companies equally and to provide increased transparency for investigated companies.

Secretary Pritzker and U.S. Trade Representative Froman, along with a high-level Government of China delegation led by Vice Premier Wang Yang, kicked off a day of side events with American and Chinese private sector leaders around the Joint Commission on Trade and Commerce (JCCT). For the first time, the JCCT schedule included a full day of events designed to facilitate private sector engagement with officials from the U.S. and Chinese governments.  

Thirty-one years after the JCCT’s inception, Secretary Pritzker, Ambassador Froman and Vice Premier Wang Yang committed to re-imagining the JCCT. Their hope is for the JCCT to serve as more of a platform for government leaders to hear from the business community, as well as continue to serve as a forum for addressing bilateral trade and investment issues and promoting commercial opportunities between the United States and China.

In the morning, both delegations participated in a roundtable with 24 business leaders from the U.S. and China, sponsored by the Paulson Institute and the U.S. Chamber of Commerce. During the roundtable discussion, government and business leaders discussed the opportunities and challenges of bilateral investment between the United States and China, including greater market access for U.S. goods and services, protection of intellectual property—including trade secrets—as well as ways to promote an efficient and level playing field in China, and how to secure best practices in regulatory enforcement, among other issues.

Later in the day at a luncheon hosted by World Business Chicago, Secretary Pritzker emphasized the importance of global commerce in promoting more openness, trade, and business between the United States and China. She also highlighted how Chinese investment in the United States has been a win-win for both countries and noted that Chinese investment has grown 42% between 2009 and 2013, supporting jobs for 14,000 U.S. workers.  

Secretary Pritzker finished the day speaking about the shared vision of a global economic partnership that exists between the United States and China. She noted that the success of the U.S.-China commercial relationship is critical to global economic growth and stability. The two economies are the largest in the world, accounting for nearly 35 percent of global GDP. Combined U.S. and China trade in goods and services add up to about one-fifth of all international trade, so the importance of the bilateral economic relationship to each other and to the global economy cannot be overstated.  

In many ways, the reimagined JCCT is an opportunity for the JCCT co-chairs to build a legacy of cooperation, respect, and stronger U.S.-China economic ties. Leaving this legacy will require a tremendous amount of work, but if it succeeds, the JCCT will become an even more effective mechanism for economic growth.  The co-chairs can use the JCCT to promote more commerce, to deepen trust, and to address real business challenges.

Frank Underwood doesn’t understand the purpose of the U.S.-China Joint Commission on Commerce and Trade (JCCT).

Maybe you know of Frank Underwood, the main character on the show House of Cards, played by Kevin Spacey. If so, you may remember how he conspired with colleagues in the White House and State Department to orchestrate a trade war with China. 

How did he do it? Through the JCCT negotiations. 

While Mr. Underwood is commonly known in the United States, it’s much less likely that the average American knows what the JCCT is, aside from it being some way for a fictional administration to create tension with a major U.S. international partner. 

Though it isn’t a household term, the importance of the JCCT can’t be overlooked. While Mr. Underwood used the JCCT to start a trade war, the reality is that the United States and China use it to support trade peace – resolving bilateral tensions and exploring areas of mutual cooperation. 

The United States and China established the JCCT in 1983 as the primary forum for addressing trade and investment issues, and promoting commercial opportunities between the two countries. 

The JCCT has since resulted in significant progress on issues U.S. businesses have identified as priority concerns in China, including:

* protection and enforcement of intellectual property rights;

* government procurement;

* standards, testing, and certifications; and

* issues specific to certain sectors like information technology, energy, and travel and tourism. <--break->

U.S. Secretary of Commerce Penny Pritzker and U.S. Trade Representative Michael Froman today in Beijing led the American delegation in the 24th session of the U.S.-China Joint Commission on Commerce and Trade (JCCT).  Hosted by Chinese Vice Premier Wang Yang, the JCCT discussions also included U.S. Secretary of Agriculture Tom Vilsack. The United States announced key outcomes in the areas of intellectual property rights, government procurement, and regulatory obstacles.

The JCCT holds high-level plenary meetings on an annual basis to review progress made by working groups that focus on a wide variety of trade issues. These working groups meet throughout the year to address topics such as intellectual property rights, agriculture, pharmaceuticals and medical devices, information technology, tourism, commercial law, environment, and statistics.

Established in 1983, the JCCT is the main forum for addressing bilateral trade issues and promoting commercial opportunities between the United States and China. The 2012 JCCT meeting was held in Washington, DC.

This week marked the conclusion of the 22nd sssion of the U.S.-China Joint Commission on Commerce and Trade (JCCT) in Chengdu, China. U.S. Secretary of Commerce John Bryson and United States Trade Representative Ron Kirk co-chaired the JCCT along with Chinese Vice Premier Wang Qishan. The trip was highlighted by meaningful progress on key elements of the U.S.-China trade relationship, though much more work remains to be done to open China’s market to U.S. exports and investment.

The work done at JCCT will help boost U.S. exports and jobs through:

  • the removal of important barriers related to electric vehicles,
  • strengthened measures to eliminate discriminatory indigenous innovation policies,
  • and stricter enforcement of intellectual property rights in China. 

“Both sides worked hard to produce some meaningful progress that will help provide a needed boost to U.S. exports and jobs,” Secretary Bryson said.  “This is a step in the right direction.  But we must continue to actively engage our Chinese counterparts to open additional opportunities for U.S. businesses.”

Specifically, China agreed to make a significant systemic change in its enforcement of intellectual property rights. Through a high-level central government enforcement structure, China will make permanent its 2010 Special IPR Campaign.  China will continue high-level involvement that will enhance its ability to crack down on intellectual property rights infringement. And in addition, China’s leadership committed to increased political accountability–the performance of provincial level officials will be measured based on enforcement of intellectual property rights in their regions.

This weekend Secretary Bryson will be in Chengdu, China for the 22nd Joint Commission on Commerce and Trade (JCCT), the annual bilateral trade negotiations between the U.S. and China. Before going to Chengdu, the Secretary stopped in Beijing to meet with American business community and Chinese investors. He participated in a meeting with the American Chamber of Commerce (AMCHAM) and the U.S.-China Business Council (USCBC), and met with members of the Chinese business community to discuss bilateral trade and investment issues. Even though he was surrounded by wonderful local cuisine, Bryson stopped off at a local U.S. franchise–Subway–to highlight the success of American brands in China, and joined U.S. Trade Representative Ron Kirk to tour Wisconsin-made airport vehicles at the Beijing Airport.

During the meeting with the American business community, Bryson shared his commitment to opening markets and leveling the playing field for U.S. companies in China and he pledged to take their issues to the JCCT meeting in Chengdu. The discussion focused on intellectual property protection, bilateral investment and China’s indigenous innovation practices.

Bryson also met with Chinese business leaders to encourage them to invest–by establishing factories, facilities, operations and offices–in the United States and to help them better understand the opportunities and ease of investing in the U.S. China's foreign direct investment in America increased nearly twelve-fold (from $0.5 billion to $5.8 billion) between 2008 and 2010. The Obama administration recently announced Select USA–the first coordinated federal effort to aggressively pursue and win new business investment in the United States while cutting red tape and removing barriers.

Secretary Locke Meets with Chinese Foreign Minister Yang Jiechi

U.S. Commerce Secretary Gary Locke met today with Chinese Foreign Minister Yang Jiechi at the Commerce Department to discuss a variety of bilateral trade issues, as well as President Hu Jintao’s upcoming visit. Locke and Minister Yang had a positive meeting, discussing the U.S.-China commercial relationship, as well as the implementation of commitments made from last month’s Joint Commission on Commerce and Trade (JCCT). JCCT issues that were touched upon included beef market access, software asset management, indigenous innovation and government procurement. Locke said he looks forward to President Hu’s visit, and continuing to strengthen the U.S.-China commercial relationship.

On December 14 and 15, Commerce Secretary Locke and U.S. Trade Representative Kirk, together with Chinese Vice Premier Wang Qishan, co-chaired the 21st annual U.S.-China Joint Commission on Commerce and Trade (JCCT) in Washington, DC.  General Counsel Kerry participated in this year’s JCCT, which covered a range of issues and yielded positive results, particularly China’s commitments to enhance its enforcement of intellectual property rights, adopt non-discriminatory government procurement policies, and collaborate with the U.S. in areas of emerging technology such as Smart Grid.  China’s commitments will lead to increased opportunities for U.S. exporters and a more level playing field for U.S. companies operating in China.   

General Counsel Kerry led the U.S. delegation’s work on commercial law cooperation.  In this area, the two sides agreed to continue to promote mutual understanding of commercial legal developments impacting U.S.-China trade.  The primary vehicle for this cooperation is the U.S.-China Legal Exchange, which GC Kerry co-leads.  The United States and China agreed to convene the 2011 Legal Exchange in the United States in cities and on topics to be determined by mutual agreement.  This builds upon the work of GC Kerry, Chinese Deputy International Trade Representative Chong Quan, and Legislative Affairs Office of the State Council Vice-Minister An Jian, who successfully led the 2010 U.S.-China Legal Exchange to Hangzhou (October 18), Wuhan (October 20), and Chengdu (October 22), which focused on U.S. export promotion activities and trade remedies laws and practices.

China Agrees to Significant Intellectual Property Rights Enforcement Initiatives, Market Opening, and Revisions to its Indigenous Innovation Policies That Will Help Boost U.S. Exports at the 21st Session of the U.S.-China Joint Commission on Commerce and Trade

Wang and Locke shaking handsToday marked the end of the 21st session of the U.S.-China Joint Commission on Commerce and Trade (JCCT) in Washington, D.C. The JCCT was co-chaired by U.S. Secretary of Commerce Gary Locke and U.S. Trade Representative Ron Kirk along with Chinese Vice Premier Wang Qishan. U.S. Secretary of Agriculture Tom Vilsack also participated in the discussions. Today’s outcomes will make U.S. businesses more competitive in China, help boost U.S. exports and jobs, and increase market access for U.S. businesses, creators, innovators, entrepreneurs, farmers and ranchers seeking to do business in China.

This morning, delegations from the United States and China began the 21st annual U.S.-China Joint Commission on Commerce and Trade (JCCT), which is our most important bilateral dialogue for resolving trade and investment issues between the two nations. As co-chairs of the JCCT, the delegations are stewards of the U.S.-China trade relationship, which is robust, supports millions of jobs for our people and is growing in both opportunity and complexity. The discussions between the delegations will help determine how well Chinese and US scientists discover together; how well our businesses collaborate; and how well our governments deal with the growing challenges of the 21st century.

Secretary Locke Sets the Stage for U.S.-China JCCT at Georgetown Policy Conference

This week, Commerce Secretary Gary Locke will convene the 21st annual U.S.-China Joint Commission on Commerce and Trade (JCCT), which is our most important bilateral dialogue for resolving trade and investment issues between the two nations.

To help set the stage for this meeting, Secretary Locke recently convened a full-day policy conference at Georgetown University exploring the U.S.-China Commercial relationship -- with most discussion panels focusing on finding ways to resolve the trade disputes that animate so much of the coverage of U.S.-China commercial interaction. 

It is an important discussion. China is the United States’ second-largest trading partner, with our bilateral trade in goods alone amounting to $365 billion last year. And U.S. exports to China are up more than 24 percent since 2008. Moreover, China and the U.S. are currently partnering to find solutions to some of the world's most pressing problems, including climate change and energy security.

For that reason, Secretary Locke made clear that the U.S. government welcomed continued strong growth in China as a way for China to improve the well-being of its citizens. As more and more Chinese move into the middle class, they will want world-class, American-made goods and that will mean more jobs here in the U.S. as our companies work to meet that demand.  

US - China Commercial Relationship Policy Conference

Last week the US Department of Commerce jointly sponsored a Policy Conference to discuss the US-China Commercial Relationship with the Jackson School of International Studies at the University of Washington, the Henry Jackson Foundation, and the host of the event, Georgetown University.  The event featured a number of panels composed of experts from all fields discussing the state and future of US-China policy.  The event was bracketed by welcoming remarks from Commerce Secretary Gary Locke and concluding remarks by General Counsel Cameron Kerry.  Kerry also participated on the conference’s final panel in a discussion of the Impact of Developments in China’s Commercial Legal System

During his remarks, General Counsel Kerry spoke about the work of his office and the Department of Commerce in developing commercial rule of law in China.  He said, "With the Rule of law, business can predict and plan their investments, research and development, purchases, and sales with greater certainty.  Without it, they are left to guess about the costs and benefits of any deal."  He discussed the importance of both the US-China Joint Commission on Commerce and Trade (JCCT) and the Strategic and Economic Dialogue (S&ED) in fostering a strong bilateral commercial relationship.  He described the US-China Legal Exchange, a program designed to foster mutual understanding of the legal regimes governing trade and investment that began in 1983. He also spoke of his role as co-lead of the Transparency Dialogue, which has led to greater transparency in Chinese Government decision-making processes, including the promulgation of rules and regulations and dialogue on transnational bribery.  He sees the role of lawyers in both countries as crucial to promoting the rule of law. 

After his panel, General Counsel Kerry concluded the conference by addressing the need for a more sustainable, balanced trade with China.  He noted that the two nations are inextricably linked to each other’s wellbeing and that China must strive to be as free, fair, and open as the United States.  The conference has helped to set the stage for the JCCT, which the US will host in Washington, DC on December 14-15, 2010.

Webcast of Secretary Locke Delivering Remarks at Policy Conference Discussing Commercial Relationship Between U.S. and China

U.S. Secretary of Commerce Gary Locke will deliver the opening remarks at a day-long policy conference that discusses the commercial relationship between the United States and China.  The forum features senior Commerce Department officials and leading experts on China’s economy, political landscape, trade networks, science and innovation policy, and environmental technologies.  In anticipation of the next U.S.-China Joint Commission on Commerce and Trade (JCCT) later in December, this conference will focus on the U.S. government’s efforts to improve market access for U.S. exports in the Chinese economy and increase opportunities for mutually beneficial trade.  This forum is jointly hosted by the U.S. Department of Commerce, the Henry M. Jackson School of International Studies at the University of Washington, the Henry M. Jackson Foundation, and Georgetown University.

Opening Day of the 2010 US-China Legal Exchange in Hangzhou, China

Alternate TextOn Monday, October 18, 2010, General Counsel Cameron Kerry and Vice Minister Chong Quan opened the 2010 US-China Legal Exchange in Hangzhou, China. The General Counsel and Vice Minister emphasized the importance of a frank and open exchange of ideas; the opening day certainly met that standard.

Courtney Gregoire, Director, National Export Initiative, International Trade Administration, offered a presentation on the Commerce-led National Export Initiative. John McInereny, Chief Counsel, Import Administration and Albert Hsu, Chief Economist, Import Administration, offered several presentations on the procedures and application of US Anti-Dumping and Countervailing Duty (CVD) law. The Chinese delegation offered comments and posed poignant questions.

In addition to an extremely productive Legal Exchange, General Counsel Kerry was warmly welcomed at Zhejiang University where he addressed and interacted with a group of law students and professors.

Tomorrow, the US delegation moves on to Wuhan for the second stop on the Legal Exchange before concluding in Chengdu on Friday, October 22, 2010.
